Terms of Service
These terms are maintained by TrainSafe Pty Ltd and apply to every account on this platform.
1. Who we are
TrainSafe Pty Ltd ("TrainSafe", "we", "us") provides rail route risk assessment, speed logging and backup communication software. You can reach us at scottyjfox@gmail.com or 0492 921 058.
2. Accounts and registration
Access to the risk assessment tool and the backup communication system requires a registered account with a username, password, employee number and nominated train operator. You are responsible for keeping your credentials confidential and for all activity under your account. Accounts are for a single named person and must not be shared.
3. Subscription and invoicing
The service is charged at AUD $299 per month, per train, plus GST. Charges are invoiced to the train operator you nominate at registration, using the accounts email address you supply. You confirm you are authorised to nominate that operator for billing. Invoices are payable within the terms stated on the invoice.
4. Safety-critical use and limitations
TrainSafe outputs are decision-support information only. Risk scores, weather summaries, maintenance alerts and recommended speeds are estimates generated from third-party data and modelling, and may be incomplete, delayed or unavailable. They never override operator rules, network control instructions, signalling, or any statutory safeworking requirement. The backup communication system supplements, and does not replace, accredited primary and emergency communication systems.
5. Acceptable use
Do not use the platform to transmit unlawful, harassing or deliberately false operational information, to attempt to access data belonging to other users or operators, to probe or disrupt our systems, or to resell access without written agreement.
6. Availability
We aim for continuous availability but do not guarantee uninterrupted service. Features that depend on external weather, elevation or maintenance data may fall back to modelled values when those sources are unreachable.
7. Liability
Nothing in these terms excludes rights under the Australian Consumer Law. To the extent permitted by law, our liability for any claim connected with the service is limited to resupplying the service or refunding the fees paid for the affected month.
8. Termination
You may stop using the service at any time. We may suspend or terminate an account for breach of these terms, for non-payment by the nominated operator, or where continued access would present a safety or security risk.
9. Changes to these terms
We may update these terms as the platform evolves. Material changes will be communicated to registered account holders. Continued use after a change means you accept the updated terms.
